The regime fee of King's Grant on the Ashley was first put into effect January 1st, 1973, in the amount of $60.00. The restrictions dated December 14th, 1972 allowed the regime fee to be increased or decreased based on the cost of living as determined by the Consumer Price Index (CPI) nearest January 1st, 1973. This was to take effect January 1st, 1974. Soon after the regime fee is instituted, a lawsuit was filed against the Homeowners' Association on behalf of the property owners stating that the $60.00 amount was higher than the CPI. The lawsuit was settled on behalf of the Homeowners' Association.
The restrictions were revised in 1984, and the regime fee remained at $60.00. The restrictions were revised again November 27th, 1986 and set an increase of the regime fee as follows: $75.00 as of January 1st, 1987 and then to $90.00 as of January 1st, 1990. The regime fee remained at $90.00 when the restrictions were again revised in 1996. The restriction revision in 1999 failed to pass an increase in the regime fee to $120.00.
Based on the CPI of 1973, the regime fee would be $242.89 in 1999. Due to the nature of the restrictions and bylaws, a 51% majority of property owners must approve a change in the restrictions, which also includes the regime fee.
The regime fee is to be used in part for the following:
Improving and maintaining the dedicated right-of-way areas maintained for the general use of the owners and occupants of the land included in the Subdivision;
Operating and maintaining any storm-water drains now or hereafter constructed in the Subdivision that are not or will not be under the direct supervision of the State or County;
Beautifying, maintaining and operating such green areas, playgrounds, parks and recreational areas as the Board of Governors deems appropriate for the mutual benefit of all owners;
Maintaining roads not under the supervision of the State or County, providing traffic control and providing such other common community services as the members shall decide are necessary or useful for the benefit of the residents of King's Grant;
Employing policemen and watchmen;
Doing any other thing necessary or desirable, in the opinion of the Board of Governors of the Association, to keep the property neat and in good order, and to eliminate fire hazards, or which in the opinion of the Board of Governors may be of benefit to the owners or the occupants of the land included in the Subdivision.
The primary use of the regime fee is the upkeep of the common green areas, marina, playground and the entranceways into King's Grant.
